How to Get an ITIN Without an SSN as a Non-Resident
An ITIN lets you deal with the IRS even though you'll never qualify for a Social Security Number. Here is what the W-7 process actually involves, and whether you need one at all.
What an ITIN is for
An Individual Taxpayer Identification Number (ITIN) is a nine-digit number the IRS issues to people who need to interact with the US tax system but are not eligible for a Social Security Number (SSN). SSNs are reserved for US citizens, permanent residents, and certain visa holders authorized to work in the US. If you are a European founder living in Europe with no US visa, you will never qualify for an SSN, and the ITIN exists specifically to fill that gap. It does not grant work authorization, immigration status, or any US benefits. Its only job is tax administration.
Do you actually need one
This is the part most guides skip. Owning a US LLC does not automatically require you to have an ITIN. The LLC itself gets an Employer Identification Number (EIN), which is a separate number for the business entity, and the EIN is what you use to open a US business bank account, apply for business cards, and file the LLC's federal information return. Non-residents can get an EIN without an SSN or ITIN by filing Form SS-4 through fax or mail.
You generally need an ITIN as an individual, not as the LLC, when one of these applies:
- You have US-source income that requires you to personally file Form 1040-NR
- You want to claim a benefit under a US tax treaty between your country and the US
- You are a member of a multi-member LLC taxed as a partnership and the partnership needs to report your share of income
- A US payer is contractually required to withhold tax on payments to you and needs a US taxpayer ID on file
If you run a single-member foreign-owned LLC with no US-source income beyond normal business operations, you may only ever need the EIN. The LLC still has to file Form 5472 alongside a pro-forma Form 1120 every year, even at zero revenue, and the foreign owner's identifying number on that form can often be a foreign tax ID rather than an ITIN. Skipping the 5472 filing is not a minor paperwork issue either, the IRS penalty starts at 25,000 dollars per missed or incomplete filing, so this is one area worth getting right regardless of whether you personally need an ITIN.
| Number | Who it identifies | Needs SSN eligibility | Typical use |
|---|---|---|---|
| EIN | The LLC (the business) | No | Bank account, cards, Form 5472, payroll |
| ITIN | You (the individual) | No, it's for people ineligible for SSN | Personal tax return, treaty claims, partnership reporting |
| SSN | You (the individual) | Yes, citizens/residents/work-authorized | US employment, benefits, personal banking history |
The W-7 process, step by step
Once you know you genuinely need an ITIN, the application runs through Form W-7, Application for IRS Individual Taxpayer Identification Number. There are a few moving parts.
1. Pick the right reason code
Form W-7 asks you to select why you are applying. Most non-resident LLC owners fall under one of the exception categories rather than attaching a full tax return, for example if a partnership is reporting your share of income, or if a US business has a contractual reporting requirement tied to your ITIN. Choosing the wrong reason code is one of the most common causes of rejection, so this is worth getting right before you submit anything.
2. Gather your identity documents
A valid, unexpired passport is the only document the IRS accepts on its own to prove both your identity and your foreign status, which is why almost every non-US applicant uses it. Without a passport you would need to combine two other documents from the IRS's approved list, which is more paperwork for no real benefit.
3. Choose how you submit
You have three practical routes:
- Mail your original passport (or a certified copy from the issuing agency) to the IRS ITIN Operations unit in Austin, Texas. This works but means being without your passport for several weeks, which is awkward if you need to travel.
- Visit an IRS Taxpayer Assistance Center in person. Not all TACs handle ITIN document verification, and most require you to physically be in the US, which is rarely convenient for European founders.
- Use a Certified Acceptance Agent (CAA). A CAA is authorized by the IRS to review your passport, verify it against the original, and certify the copy that gets submitted with your W-7. This means you keep your passport with you the entire time. It is the most practical route for anyone outside the US.
The difference between a plain Acceptance Agent and a Certified Acceptance Agent matters here. A standard Acceptance Agent can help you prepare the form but still generally requires the original passport to be sent to the IRS. A CAA can certify the document itself, which is what actually saves you from mailing your passport abroad.
Common mistakes that cause rejections
- Selecting the wrong exception category or reason code on the W-7
- Submitting a passport copy that isn't properly certified
- Missing supporting documentation required by the specific exception (such as a partnership agreement or withholding statement)
- Applying for an ITIN speculatively, before there is an actual tax filing or treaty reason that requires one
How long it takes
The IRS typically states around seven weeks for domestic processing, and nine to eleven weeks if you're applying from outside the United States or during peak filing season, roughly January through April. Build that timeline into any plans that depend on having the ITIN in hand, such as a treaty-based tax return deadline.
Where this fits with your LLC and EIN
For most European founders setting up a US LLC purely to invoice international clients, hold a US business bank account, and get a US business card, the sequence is usually: form the LLC (Wyoming is the common low-cost default for non-residents because of its light ongoing compliance and privacy), get the EIN, open the bank account, and file the annual Form 5472 and pro-forma 1120. The ITIN only enters the picture later, if you personally take on a US filing obligation. Founders Credit handles the LLC formation, EIN, bank account, and card setup as one done-for-you process, and can point you toward a Certified Acceptance Agent if and when an ITIN actually becomes necessary for your situation, rather than applying for one you don't yet need.

SSN: Social Security Number, issued to US citizens, residents, and work-authorized visa holders. EIN: Employer Identification Number, the tax ID for a business entity like your LLC, obtainable by non-residents via Form SS-4. W-7: The IRS form used to apply for an ITIN. CAA: Certified Acceptance Agent, an IRS-authorized person who can verify and certify your passport for a W-7 application without you mailing the original. Form 5472: An annual information return required from foreign-owned single-member LLCs, filed with a pro-forma Form 1120, with a 25,000 dollar penalty for failing to file. Disregarded entity: A single-member LLC that is not taxed separately from its owner for federal purposes, though it still has separate reporting obligations like Form 5472.
Frequently asked questions
Can I get an ITIN if I have never had a US visa?
Yes. The ITIN exists specifically for people who are not eligible for a Social Security Number, which includes most non-resident founders who have never held a US visa. Eligibility for an ITIN is based on having a valid tax reason to interact with the IRS, not on immigration status.
Do I need an ITIN just to open a US business bank account for my LLC?
No. Business bank accounts are opened using the LLC's EIN, not a personal ITIN. Non-residents can obtain an EIN through Form SS-4 without holding an SSN or ITIN, and that EIN is what banks like Mercury, Wise, or Relay use to onboard the business remotely.
What is the difference between an Acceptance Agent and a Certified Acceptance Agent?
A standard Acceptance Agent can help prepare your W-7 but typically still requires the original passport to be mailed to the IRS. A Certified Acceptance Agent (CAA) is authorized to verify your passport in person or via video, certify a copy, and submit that certified copy, meaning you keep your passport with you the whole time.
Will applying for an ITIN affect my LLC's Form 5472 filing?
Not directly. Form 5472 is an information return for the LLC, filed using the EIN, and it does not itself calculate tax owed. The form asks for the foreign owner's taxpayer identification, and a foreign tax ID can often be used there if you have not been issued a US ITIN, so the two processes are related but separate.
How long does it realistically take to get an ITIN from Europe?
The IRS generally quotes around seven weeks for ITIN processing, extending to nine or eleven weeks for applications submitted from outside the US or during the busy January to April filing season. Using a Certified Acceptance Agent does not usually speed up IRS processing itself, but it does remove the delay and risk of mailing your passport internationally.
